Decision to set aside Abrahams decision ‘no surprise’

The High Court has set aside the National Director of
Public Prosecutions Shaun Abrahams' decision to withdraw charges against his
deputy, Nomgcobo Jiba.

This means fraud and perjury charges against Jiba are reinstated. She is accused of unlawfully authorising racketeering charges against former KwaZulu-Natal Hawks boss, Johan Booysen.
Freedom Under Law's Judge Johann Kriegler says the ruling comes as no surprise.
''This means our long haul to try and clear out the stable of the NPA has gone a couple of steps further.''
Abrahams defied advice from two state advocates to prosecute Jiba.
He based his decision on a legal opinion that argued Jiba couldn't be held criminally liable for her actions because she acted in good faith.
However, this was rejected by the High Court and instead held the view that Jiba faced serious criminal offenses.
The court decision also set aside president Jacob Zuma's failure to institute disciplinary proceedings against Jiba and advocate Lawrence Mrwebi.
Jiba and Mrwebi have both been struck from the roll of advocates.
