On Tuesday, the High Court in Pretoria adjourned the trial to allow the defence to study the documents and consult with the accused on additional evidence that the State had supplied.

Five men are on trial for gunning down the former Bafana Bafana captain in October 2014.

Defence counsel, Advocate Zandile Mshololo, compared the State’s failure to provide them with the documents to an ambush.

“This a trial by ambush, my Lord,” she told Judge Ratha Mokgoatlheng.

“Yesterday (Wednesday)I had the whole day to consult with my client on all the documents that the State is planning to use. However, the documents were not supplied to me, especially the affidavits that were marked by Mr Baloyi, that there are pages which are missing.

Mshololo also accused the State of lying when it said more time was needed to investigate and compile the necessary records.

“What is very bad in this trial is that the State is dishonest with this court, and they need time to investigate and compile all the necessary records that are supposed to be supplied to the defence.”

The trial is expected to resume on May 13.
