Drama at Meyiwa trial as defence counsel admits to sharing ‘confidential’ documents

It was a day of high drama in the High Court in Pretoria, with witness Sergeant Vusumuzi Mogane accusing the defence counsel in the Senzo Meyiwa murder trial of sharing confidential information with their clients.

On Tuesday, the court ordered Mogane to share some of the cases he had worked on from 18 June 2020, when accused number two Bongani Ntanzi was arrested.

However, during Wednesday’s court proceedings, Mogane told the court he believed the documents, which he first handed to state advocate George Baloyi, were now circulating among the accused. 

"Yesterday, the court asked me for documents that I was working on. I brought them as requested. I wrote down the names of the cases and those of the accused. I also gave it to Baloyi, contained in an envelope written confidential. During the break, I saw the document now going around in court.” 

 

"Who else had that document? questioned Judge Ratha Mokgoathleng.

"I saw (accused) Muzi (Sibiya) had it and the others who were reading it," said Mogane. 

Mogane also told the court some of the evidence has the potential to destroy witnesses. 

"Some of the cases also affect some of the accused. I will not mention them. In all these cases, there are firearms involved. Some people were shot while others were kidnapped."

 

Counsel for accused number four, Advocate Zithulele Nxumalo, conceded that he was the one who shared some information with his client, Mthokoziseni Maphisa. 

 

Nxumalo defended his decision by saying one of the cases involved his client.
