Etzebeth has applied to review and set aside the commission's decision to institute legal proceedings against him.

In a statement, the commission says it is studying his review and will soon decide on an official response.

The commission is representing the so-called Langebaan Four in the Equality Court.

The group is accusing the Springbok lock of assault and the use of a racial slur during an incident at a pub in Langebaan.

The alleged incident took place only weeks before Etzebeth was set to board a plane for the Rugby World Cup in Japan.

Meanwhile, the commission's Buang Jones visited Langebaan in the wake of the incident and told community members that the SAHRC did not care about the offender's prominence or standing in society and that Etzebeth "always got away" with such conduct.
