Malema and five other senior members of the party are serving a month-long suspension for interrupting last year's address and won’t be able to attend this year’s SONA.

The Western Cape High Court on Thursday confirmed its decision to deny the EFF application to overturn the suspension of some of their MPs.

In November, Parliament's Powers and Privileges Committee ordered six EFF MPs, including party leader Julius Malema and his deputy Floyd Shivambu, to apologise to President Cyril Ramaphosa for disrupting his State of the Nation Address in February.

They were also ordered to apologise to National Assembly Speaker Nosiviwe Mapisa-Nqakula, the parliament and the public.

Addressing EFF supporters in KwaZulu-Natal on Wednesday, Malema said the president will still be held accountable.

"When we are in parliament, we are fighting for the land. That's why today we are prevented to come to the State of the Nation Address because they know that we will go there and fight and fight for our land.

"We fought with (former president Jacob) Zuma. Zuma has never banned us from going to parliament. Today a man that they said is the most democratic man, a transparent man, a man who is not corrupt has banned the EFF from participating in the State of the Nation Address because he is scared of the EFF.

“But you will never suppress the voice of the voiceless because, whether Malema is in parliament or not, members of the EFF are there in parliament, and the presence of the EFF will be felt there," Malema said.
