Gerrie Nel sets his sights on Nomgcobo Jiba

AfriForum and former state prosecutor, Advocate Gerrie Nel, will pursue a private prosecution against National Prosecuting Authority (NPA) deputy national director of public prosecutions Nomgcobo Jiba.

The matter relates to charges of racketeering that Jiba instituted against former KwaZulu-Natal Hawks boss Johan Booysen


The charges were set aside in the KwaZulu-Natal High Court in 2014. 


AfriForum CEO Kallie Kriel says Jiba was trying protect a close friend of President Jacob Zuma


"General Booysen supervised an investigation of fraud and corruption against a certain Colonel Madu and a KZN business man, Toshan Panday. Panday is said to have links with President Jacob Zuma and that is where the plot thickens, that Booysen decided to investigate somebody with links to Zuma."


Kriel says Booysen was offered money to tamper with documents, but he refused. 



The National Director of Public Prosecutions, Shaun Abrahams, withdrew charges of fraud and perjury against Jiba in 2015. 


Nel will pursue charges of fraud, perjury and defeating the ends of justice against Jiba. 


Booysen, who was also in attendance, thanked AfriForum for its assistance.  


"As you are aware litigation can be very expensive and I have been litigating for about five or six years. I am grateful that AfriForum has come to my aid. I believe we are all equal before the law and this instance the NPA has abrogated its constitutional mandate by withdrawing charges against Jiba. Hence I am pursuing this private prosecution."  


AfriForum says it served the NPA with an application to prosecute Jiba this morning.
