The leader of the Corrections and Civil Rights Movement (CCRM) was arrested at the High Court in Pretoria on Tuesday for wearing a prisoners' uniform, the correctional services department said.
CCRM leader Golden Miles Bhudu was arrested for contravening the Correctional Services Act, spokesman Manelisi Wolela said in a statement.
The act prohibits any unauthorised person from wearing or using prescribed sentenced offender uniform or anything resembling it. The offence is punishable by a prison sentence of up to 18 months, a fine, or both.
Bhudu said he was arrested for "a crime I never committed", but he was later released.
He said he was wearing an old prisoner's uniform, stamped with the word "prisoner", which was outlawed following a 2008 high court ruling that it was degrading and stigmatised inmates.
The old uniform was replaced with one marked "corrections", Bhudu said.
He was wearing the old uniform at the High Court in Pretoria on Tuesday, where a CCRM court application to delay the May 7 general elections was struck from the court roll.
The application sought to have the identity documents of prisoners collected by courier, to enable prisoners to register to vote. It was struck from the court roll due to a technicality, Bhudu said.
He said it was not clear when he would have to appear in court, but he would present the 2008 ruling on prison uniforms to bolster his case.
