Gordhan case against Malema, Shivambu postponed
Updated | By Gaopalelwe Phalaetsile
The case against Economic Freedom Fighters (EFF) leader Julius Malema
and his deputy Floyd Shivambu has been postponed to February 11 by the Equality
Court in Johannesburg.
Last year, Public Enterprises Minister Pravin Gordhan laid
charges of crimen injuria against the pair for comments made outside the
commission of inquiry into state capture.
Malema and Shivambu accused Gordhan and his daughter of corruption, while also
labelling the minister a “dog of white monopoly capital”.
The three were not at the court, but their legal
representatives brought an application to have the matter transferred to the
high court.
Malema and Shivambu also indicted through their lawyer advocate, Tembeka
Ngcukaitobi, their intention to challenge section 10 of the Equality Act -
which focuses on words that amount to hate speech.
The act makes an example of words such as baboon and the word which it says are
harmful and incite hate.
Magistrate Nishani Bahorie will announce whether the matter will be transferred
on February 11.
