Gordhan: Mkhwebane’s ConCourt turn-around ‘unexpected’

The legal representative of Public Enterprises Minister Pravin Gordhan has reacted to Public Protector Busisiwe Mkhwebane’s withdrawal of her Constitutional Court bid to appeal his interdict.

“We were taken aback about it as it was unexpected,” said Gordhan’s lawyer Tebogo Malatji on Thursday.

Mkhwebane petitioned the highest court in the land to overturn the interdict granted to Gordhan over the implementation of her remedial action.


The high court in Pretoria dubbed Mkhwebane’s remedial action as “nonsensical”, “vague” and “contradictory”.

Mkhwebane found that Gordhan unlawfully established the so-called Roque Unit aimed at clamping down on various syndicates who were infiltrating the revenue service.


“It is probably a withdrawal following on legal counsel that the application to the Constitutional Court has poor prospects of success,” said Malatji.
