The Independent Electoral Commission (IEC) will file its documents with the Constitution Court to have this year’s local government elections postponed.
Chairperson of the Commission Glen Mashinini says the papers will be submitted by Wednesday.
“Our view is that we believe that the Moseneke report has enabled us to be in a position to take to the ConCourt our submission that it is not possible under these circumstances for us to discharge our responsibilities.

“However as matters stand the elections have been declared and we are opening the timetable as per the prescription of our law. We do not believe we are acting in violation. My understanding is that this afternoon we will be filing as far as the affidavit and all supporting documentation. I can indicate that I have already signed all those documents so it's a matter of when they compile them, package and deliver.”
In his report, retired Chief Justice Dikgang Moseneke recommended that the October government elections be postponed to February 2022.
The health risks posed by the Covid-19 pandemic has been cited as the reason to defer the elections.
