It emerged on Thursday that retired Constitutional Court justice Yvonne Mokgoro recommended the sacking of both Jiba and special director of public prosecutions Lawrence Mrwebi from the National Prosecuting Authority. .

The commission probed the fitness of Jiba and Mrwebi to hold office after they were suspended by President Cyril Ramaphosa pending the outcome of the inquiry.

Zola Majavu says while they received the Mokgoro report from the president two weeks ago, and have since sent their submission, he cannot divulge any details.

"We did receive the report from the president approximately two weeks ago and the president specifically requested us, on behalf of our client, to make written submission before he made his final decision on the recommendation of the report.

"We duly complied with the president’s request and sent our extensive submission on what our instructions are pertaining to the report and its findings, and currently we are still waiting for the president to come back to us once he had an opportunity to consider those submissions. We are therefore not in a position to comment what has been reported in the media, " Majavu says.

Meanwhile, the DA’s Glynnis Breytenbach says if the media reports are accurate, it would be a positive move for the NPA and the criminal justice system.

Breytenbach testified before the commission in January where she told judge Mokgoro that Nomgcobo Jiba was partly responsible for the mess at the NPA

"Again, justice Mokgoro has got it right, she's written a very comprehensive report, calling for Jiba and Mrwebi to be fired, I couldn't agree more.

"They have allowed the NPA in particular and the national justice system to be decimated, " Breytenbach says.
