Julius Malema in court

The EFF's Commander-in-Chief, Julius Malema will appear in the Newcastle Magistrate Court in KwaZulu-Natal for allegedly contravening the Riotous Assemblies Act of 1956.

"This law, which is essentially an apartheid law that was not transformed by the government of the ANC, was historically used in the 1960s to put many liberation fighters behind bars, including the accused of the Rivonia Trail," the EFF said in statement.
The party added that the ANC government alleges that Malema has contravened the act during the 61st anniversary of the Freedom Charter in June this year.
"Malema told our people that they have the right to occupy land wherever they choose," according to the statement.

They also added that Malema quoted directly from the Freedom Charter which states that: "All shall have the right to occupy land wherever they choose".
"So in essence, Julius Malema is charged for speaking about the Freedom Charter," the party said.
