Kana evidence unusable

The pointing out of the crime scene by a man accused of raping and killing 17-year-old Anene Booysen cannot be used as evidence, the Swellendam Circuit Court concluded on Monday.

SABC radio reported that the court ruled, without giving reasons, that Johannes Kana's pointing out of the crime scene in Bredasdorp could not be used.
 
The court reportedly said it would give its reasons for the ruling at a later date.
 
Kana's lawyer Pieter du Toit earlier told the court his constitutional rights had been violated because he was not told what he said could be used against him in court.
 
According to the SABC, Du Toit said he was happy with the ruling and that it gave Kana a fighting chance.
 
The trial continues on Tuesday.
 
Kana has admitted leaving a Bredasdorp pub with Booysen, and hitting and raping her, but he has denied killing her.
 
Booysen was raped and disembowelled, and died in the Tygerberg hospital on the afternoon of Saturday, February 2.
