Khusela Diko hits out at ANC, to challenge step aside decision

Suspended Presidential spokesperson Khusela Diko will appeal a decision by the African National Congress (ANC) that she must step aside as a member of the provincial executive committee in Gauteng

In a statement through her lawyers, Avela Nontso Attorneys, Diko said the findings made by the provincial disciplinary committee against her are irrational and cannot be left unchallenged. 

 

"She will be exercising her rights to review/appeal the factual, substantial and procedural findings of the DPC in terms of rule 25.35 and 25.36 of the ANC Constitution within the timeframes prescribed by the constitution. 

 

"Pending the outcome of the above-mentioned processes it our understanding that the PDC decision and findings will be stayed and any communication internally and/or to the public should also communicate our clients' instructions and intention to exercise the above-mentioned rights," the statement said.

Diko was found guilty of bringing the party into disrepute following the  involvement of her late husband Amabhca King Madzikane II Diko's company Royal Bhaca in the Gauteng personal protective equipmentscandal.

 

Her attorneys have also taken issue with statements made by the Gauteng ANC provincial secretary Jacob Khawe, who said they were not aware that Diko was appealing to the media. 

 

The letter informing the ANC that Diko would be appealing the decision was sent on April 12 according to the law firm. 

 

Diko has also described the findings of the PDC as baseless.
