Correctional Services spokesperson Singabakho Nxumalo on Wednesday said Lamola will make a decision “at the right time”.

“That decision will be made by the correct authority which is the minister. I do believe and know for a fact that he will make his intentions known publicly. So, at the right time he will do so.”

Nxumalo’s remarks follow the announcement by the South African Communist Party (SACP) that it had filed papers at the Constitutional Court to keep Chris Hani’s killer behind bars.

Walus shot and killed the ANC and SACP leader in the driveway of his Boksburg home in 1993.

According to the SACP, the papers were filed at the apex court on Tuesday.

Nxumalo said Lamola will follow the appropriate legal framework when making a decision on Walus’ release date.

The Constitutional Court gave the minister until 30 November to release the Polish immigrant on parole.

“What guides us here is that there is an appropriate authority who gets to make that decision, and with this decision particular one it’s the minister,” said Nxumalo.

“Yes there is a court order but the minister will do what he needs to follow legally so. So at the right time the minister will make his intentions known.”

Walus was on Wednesday receiving medical treatment after he was stabbed by an inmate at the Kgosi Mampuru prison in Tshwane.
