LISTEN: Court orders Tshwane to reconnect water, electricity to Club Crossing Shopping Centre

The High Court in Pretoria has ruled that the City of Tshwane should reconnect water and electricity to Club Crossing Shopping Centre on Friday.

Advocate Francois Botes, who represented the mall in Friday’s urgent application, says municipal officers’ shutdown both water and electricity without prior warning on Wednesday was illegal.

“This past Wednesday municipal officials rocked up together with journalists at the shopping centre and suddenly terminated and disconnected all water and electricity supply, without giving the client a warning that they intend to do so and very importantly, without comply in manner what so ever with the provisions of section 27 (1) of the Municipal Property Rates Act , Act no.6 of 2004.”

 The urgent application, which was heard on Friday morning  due to the extreme urgency, ordered Tshwane to return services with immediate effect

“The Respondent are orded to rstore the water and electricity supply (which it disconnected) to the Applicant also known as Club Crossing Shopping Centre with immediate effect,” the court said.

Botes says they hope Tshwane comply or else they will return to the courts

“Hopefully once this order is brought to the attention of the municipality, they will comply. . . Failing which we will return to the court later this afternoon to apply for an order in terms of which the municipal officials, including the municipal manager and mayor be held in contempt of the court order.”
