The National Prosecuting Authority (NPA) has received a summons from the man initially accused of killing Bafana Bafana captain Senzo Meyiwa, it said on Friday.

"The NPA can confirm that it received summons in the matter. There is a unit within the NPA called the legal affairs division, which is looking into the matter," spokesperson Velekhaya Mghobhozi said.

He said the NPA had received the summons on April 17. A court date has not yet been set.

The Star reported on Friday that Zamokuhle Innocent Mbatha was suing both Police Minister Nathi Nhleko and NPA head Mxolisi Nxasana for defamation, unlawful and wrongful arrest, and malicious prosecution.

He was reportedly suing Nhleko for R7.5m - R5m for defamation and R2.5m for wrongful arrest - and Nxasana for R2.5m for malicious prosecution.

When asked for the ministry's response to the suit, Nhleko's spokesperson Musa Zondi told News24: "He's got the right to sue and we will take it from there in court."

Mbatha was arrested on October 29 last year after Meyiwa was shot and killed in Vosloorus, Ekurhuleni, while visiting his singer and actress girlfriend Kelly Khumalo three days earlier.

Mbatha was released on November 11 after the murder charges against him were withdrawn in the Boksburg Magistrate's Court due to insufficient evidence.
