LISTEN: Jiba implicated in ousting former NPA head Nxasana

Former deputy director of Public Prosecutions, Nomgcobo Jiba has been implicating in orchestrating the removal of former National Director of Public Prosecutions (NDPP) Mxolisi Nxasana in a bid to take his position.

She apparently conspired to remove Nxasana in a bid to succeed him as head of prosecution.

 In 2019, Nxasana told the commission of inquiry into state capture that he had evidence of this plan from an employee at the NPA Terence Joubert.

 Joubert, who he is currently employed a senior investigator at the NPA, appeared before the commission on Friday,

 He has handed over recordings to the commission in which a senior KwaZulu-Natal top cop, Colonel Welcome Mhlongo, discussed the plan to sabotage Nxasana over the phone.

 Joubert told the commission that shortly after Nxasana's appointment in 2013, he got a call from the former head of the Asset Forfeiture Unit, who informed him that Mhlongo asked him to assist with information regarding a murder investigation related to the building of a stadium during the 2010 World Cup.

 He said he called Mhlongo at his office. At the time, Mhlongo was seconded to the NPA but still employed by the SAPS.

 Joubert told the commission he warned Mhlongo about the murder investigation and told him it would get him fired.

 He said while Mhlongo was in his office, he made an interesting phone call.

 "I remember he mentioned that there was supposed to be a murder investigation in Umlazi somewhere and Nxasana was the suspect. He also mentioned that Nxasana's wife was working for the Road Accident Fund and how they can try to get enough information from the RAF, he was on the phone with someone else, not talking to me.

 "He also mentioned that they can deal with Nxasana as they dealt with Gumede. I don't know who Gumede is. The statement he made is that Jiba is the best person for the job and Nxasana should not have been appointed due to all his criminal investigations and that is when I started recording that conversation."

 Joubert explained that Mhlongo wanted information from the RAF that could taint Nxasana as there was information that he had done work with the company while his wife was employed there.

Advocate Garth Hulley asked him if he knew who had instructed Mhlongo to dig into Nxasana's past.

He said he did not know, but Mhlongo had informed him that it was Jiba who made the instruction.

Nxasana left the NPA in 2015 after he was forced out of office and received a multi-million rand settlement by former president Jacob Zuma.

 In August 2018, the Constitutional Court found that the settlement had been unlawufl and ordered Nxasana to pay it back.
