Magudumana to appeal High Court ruling on 'unlawful arrest'
Updated | By Cliff Shiko
The lawyers representing Dr Nandipha Magudumana have confirmed that they will be appealing the High Court ruling which dismissed her urgent application to have her arrest in Tanzania declared unlawful.
Magudumana was arrested together with convicted murderer and rapist Thabo Bester in Tanzania in April.
She is accused of helping Bester escape from the Mangaung Correctional Centre in May last year.
Her attorney Machini Motloung says they believe another court will arrive at a different conclusion.
"Yes, we will be appealing the judgment that was handed down this morning. We are not convinced with the reasons that were given and we are of the view that another court will arrive at a different conclusion.
"The issue at hand now lies on the perceived consent, we are of the view that that conclusion is appealable and there are legal grounds to launch an appeal against the decision of the Free State High Court."
Magudumana remains in custody at the Kroonstad Correctional Centre in the Free State.
