Man in court for alleged rape, murder, 16 years ago

A man (38) appeared in court, for his alleged involvement in the gang rape and brutal murder of a teenage girl on the Cape Flats 16 years ago.
Because he faces a rape charge, he may not be named until his trial commences in the Western Cape High Court.
He was arrested on 11 September and made his second appearance on Monday, in the Blue Downs District Court, before magistrate Gerald Hattingh.
The magistrate ordered he remain in custody, and postponed the case to October 16.
The Western Cape Directorate for Public Prosecutions has allocated the matter to senior State advocate, Louis van Niekerk, who prosecuted and secured convictions against the three others involved in the rape and slaying.
The man has not yet indicated any intention to apply for bail but, at Monday’s proceedings, the prosecutor said the State would oppose bail.
The prosecutor said the charges would be framed under Schedule 6 of the Criminal procedure Act.
This means that, if he applies for bail he will have to satisfy the court that there are substantial and compelling circumstances justifying his release on bail.
The alleged incident happened in the early hours of Sunday, 27 June 1999, in a derelict house near a shebeen, where the girl’s throat was slit after she had been raped and stabbed at least 50 times.
