Maqubela wants to be released ahead of her sentencing proceedings, which are scheduled to continue on February 17 next year.
She has been in jail since November 7 after she was found guilty of the murder of her husband, acting judge Patrick Maqubela.
Judge Maqubela was found dead in June 2009.
He had been suffocated with cling-wrap in his Sea Point, Cape Town, apartment.
The court found that Maqubela's serial adultery had brought the relationship with his wife to an explosive point in 2009. He was in a distressed state and confided to others the day before he was killed that he wanted to divorce his wife.
Thandi Maqubela was arrested along with Vela Mabena for her husband's murder.
Mabena was acquitted.
