Mark Kingon to remain at the helm of Sars

The acting commissioner of the South African Revenue Service (Sars), Mark Kingon, will remain in his position for a further three months.

This is after a decision by Finance Minister Tito Mboweni to further extend his contract.


It is the third time that Kingon's contract as acting commissioner has been extended.  


"This is because the process to appoint a commissioner on a permanent basis, has only been initiated following a court judgement earlier this week," says Treasury’s deputy director-general Ismail Momoniat.


 


The position of Sars commissioner became vacant when Tom Moyane was initially suspended and later fired from his position by President Cyril Ramaphosa.



His dismissal came after a recommendation by retired Judge Robert Nugent, who heads up the commission of inquiry into the revenue service. 


 


Kingon's contract will be extended by a further 90 days, when a new permanent commissioner is expected to be appointed.


 


"Section 7 of the SARS Act empowers the Minister of Finance to appoint an acting commissioner.



"The President, however, appoints a permanent commissioner.



Following the judgement of the High Court (Gauteng Division) of 11 December in TS Moyane v President and Others, the Minister of Finance will assist the President in immediately commencing the process to appoint a new Commissioner of Sars,” says Momoniat.


 


Mboweni is expected to submit a shortlist of names for members of an interview panel for the president’s approval.


 


After interviews, which are envisaged to be private in nature, the interview panel will recommend a candidate, or candidates, to the president.
