The department will also examine whether it can legally extricate itself from these deals.

Masutha was speaking on the first day in office of new National Prosecuting Authority head Shamila Batohi on Friday.

He said a team has been set up to probe the department’s entire contractual history with the controversial facilities management company.

Masutha said he cannot understand why government funds are outsourced to provide services such as catering.

" I have also asked how did we end up in a situation wherein so many years down the line we have not been able to develop our own in house-capacity to provide catering for our inmates in the big centres, where Bosasa has been providing the service and end up in this - as referred to - evergreen contractual agreement."

Masutha said the reasons for the outsourcing ranged from obsolete equipment to a lack of funding.

Masutha also questioned why the acting NPA head has not issued criminal charges following the Bosasa SIU investigation adding that he does not believe the state capture inquiry needs to be finalised for criminal prosecutions to proceed.
