He was suspended by Police Minister Nathi Nhleko for his connection with the so-called Zimbabwean rendition case dating back to 2010/2011.

McBride's suspension was found to be unlawful by the High Court earlier this year and he then turned to the highest court in the land asking for this to be confirmed.

The Court has set aside McBride's suspension for 30 days, during which time Parliament has a window to initiate disciplinary processes should it see fit to do so.

Parliament has also been given 24 months in which to address the deficiencies in the Acts pertaining to IPID's independence.

Speaking to media outside the court, McBride thanked everyone for their support, and explained the process going forward.

"We are happy with the judgement and as soon as the 30 days are over we would like to get back to work and start stabilising IPID. Also, I think it's important there a lesson that is learnt, especially for the executive and in particular the minister in how not to govern and how not to interfere with an independent organisation," he said.
