Merc Woolies looter sentencing continues today

Sentencing proceedings in the case against the Mercedes-Benz driver convicted of stealing groceries from Woolworths during the 2021 July unrest will continue in the Durban High Court on Friday.
Mbuso Moloi was seen in video footage stealing items from a Woolworths store in Durban's Essenwood area during the public violence and looting and getting into the luxury vehicle.
The 32-year-old has since pleaded guilty to theft and contravention of the National Road Traffic Regulation as the vehicle did not have the requisite license plates.
The matter was last postponed for the court to receive pre-sentence reports.
Legal Expert, Sunil Singh, explained what these reports could contain.
"The Correctional Service's report deals with the issue of where he lives and how long he has been living for - the issue of him being a monitorable candidate. In other words, if the court has to give him a sentence in terms of section 276 (1) H, which is house arrest, he will then be a monitorable candidate for that purpose.
"Also, in the report of the probation officer, they will look at his personal circumstances - if he is married, his employment, educational history.
"At the end of that report, what they will do is they will make recommendations to the effect is he a candidate suitable, considering the offences he is convicted for, will he be a suitable candidate for either a sentence in terms of section 276 (1) H, correctional supervision and house arrest."
His vehicle, a Mercedes-Benz C300 coupe, has since been forfeited by the NPA's Asset Forfeiture Unit.
