Mkhwebane vows to take Section 194 report on review

Suspended public protector Busisiwe Mkhwebane has vowed to challenge the report by the parliamentary committee probing her fitness to hold office.

Mkhwebane briefed the media in Midrand on Wednesday.


The parliamentary inquiry into Mkhwebane’s fitness to hold office has found her guilty on charges of misconduct and incompetence, paving the way for an impeachment vote in the National Assembly.


On Wednesday, Mkhwebane slammed the DA and ANC, accusing the the two parties of working together to ensure she doesn't receive gratuity at the end of her term in October.


"The process is now defined by the mistaken desire to deny me my hard-earned benefits, which cannot be taken away in terms of the law. Neither the National Assembly nor the president is entitled to act in any manner which is so plainly irrational, illegal and driven by ulterior and improper motives.


“In order for the dreams of the DA to be fulfilled, within the month of September, the item must be scheduled in the programme of the National Assembly, the vote for the two-thirds majority must then take place, the report must be sent to the president, and he must send me a letter of removal.


“Without a proper motive, this is impossible to achieve in the available time. “


“On my side, I will not allow my name you be abused for political and racist agendas unrelated to the intentions of the Constitution," says Mkhwebane.


Mkhwebane vowed to continue the fight to clear her name.


"We will take the report on review, and we still finalising the strategy on whether to interdict whilst reviewing it lodge a review application.”


The final report by the Section 194 Committee made serious adverse findings of misconduct against Mkhwebane across a range of investigations, reports, and her handling of subsequent litigation, as well as matters related to the expenditure of public funds.


The committee, chaired by ANC MP Richard Dtyantyi, said Mkhwebane had not provided written comment on the committee’s draft report, which was sent to her on 11 August with an opportunity to provide written responses by 21 August.


Committee members from the ANC, DA, ACDP, Freedom Front Plus and IFP all voted in favour of the adoption of the final report.


The EFF and the ATM voted against the adoption of the report, saying they would take the report on review, while Al Jama-ah felt the penalty of removal was too harsh.


Two-thirds of the National Assembly must now support the report for adoption and Mkhwebane's ultimate removal.
