Mkhwebane withdraws ConCourt application

Public Protector Busisiwe Mkhwebane has withdrawn Constitutional Court application seeking to appeal the judgment against her by Judge Sulet Potterill.

Mkhwebane's spokesperson Oupa Segalwe confirmed the withdrawal on Thursday.
Mkhwebane was appealing the decision by high court in Pretoria to suspend her remedial action against Public Enterprises Minister Pravin Gordhan.
Gordhan lodged an urgent application to interdict and suspend the remedial orders by the public protector, describing her motives as improper.

Mkhwebane had found that Gordhan violated the executive ethics code in relation to the so-called rogue unit at the South African Revenue Service (Sars).
She ordered President Cyril Ramaphosa to act against Gordhan within 30 days.
"I confirm the withdrawal but I am not at liberty to talk about the reasons or the way forward. PP took advice from her legal team, leading to that decision,” Segalwe said in a statement.
In the judgement, Potterill described Mkhwebane’s remedial action as “nonsensical”, “vague” and “contradictory”.
