Myeni reveals identity of protected witness at Zondo commission

Events at the commission of inquiry into state capture took an astonishing turn on Thursday when former South African Airways (SAA) chairperson Dudu Myeni revealed the identity of a protected witness known as “Mr. X”.

Earlier this year, Mr. X told the commission that his company had been used by one of Myeni’s son firms to deposit R3 million.

 

Myeni, who continued her testimony via Zoom, still upheld her privilege to “invoke her right to silence”.

 

However, just before the commission adjourned for lunch, Myeni told chairperson Deputy Chief Justice Raymond Zondo that there is no truth in hiding Mr. X's identity as he is part of her family.

 

"(Identifying his name) is my family. His children are my children. He is my brother.

 

"There is no truth in hiding his identity," Myeni said.

 

Evidence leader, Advocate Kate Hofmeyer, described Myeni’s conduct as wilful obstruction of the commission.

"It reveals a disrespect of this commission and will send a chill over these proceedings because it is liable to deter future whistleblowers from coming forward.

 

"We submit that you should direct the secretary of the commission to lay a charge against Ms Myeni for breaching the commission so that justice can take its course," Hofmeyer said.

 

Myeni’s lawyers say they understand the seriousness of what Myeni did and will file their submission by Monday morning.

 

Zondo responded to the matter, telling Myeni that he is disappointed in her conduct.

 

He echoed Hofmeyer's sentiments that the revelation of Mr.X's identity may harm the commission.

 

"When something happens in the commission it undermines the work o the commission in a very serious way.

 

"To say I am disappointed you did, particularly after I said his identity must not be revealed.”

 

Myeni has since apologised saying her intentions were not to disrespect the commission.

 

Myeni said she did not reveal his identity wilfully but out of familiarity.
