The next round in Moyane vs the President

Former South African Revenue Service (Sars) Commissioner has filed an urgent application to overturn the decision by President Cyril Ramaphosa to fire him.

Ramaphosa fired Moyane on the first of November, after months of back and forth with the embattled former tax boss fighting the disciplinary processes against him, as well as the findings by the Nugent Commission of Inquiry.

Moyane gave the president until noon on Friday, 16 November to reinstate him, maintaining his axing was unlawful.

Ramaphosa responded saying that he would not undo his decision.

The Sars Commission of Inquiry was set up to investigate governance issues at the embattled state tax collector and the reasons for the shortfall of some R100 billion in revenue collection over the past four years - under Moyane's watch. 

Moyane is also asking the North Gauteng High Court in Pretoria to stop the president from taking any action related to the recommendation by the Commission, until Moyane's Constitutional Court application is finalised
