Judge Dunstan Mlambo found Abrahams' appointment to be unconstitutional.

The court also found that the termination of former prosecutions boss Mxolisi Nxasana's contract to have been invalid and ordered him to that pay back the R17 million.

Mlambo however said the court doesn't believe Nxasana should be reinstated, but that the position should be left vacant until another appointment is made.

This appointment cannot be made by President Jacob Zuma, as the court believes him to be "conflicted".

The power has now been given to Deputy President Cyril Ramaphosa.

The court said due to the spectre of criminal prosecution hanging over the head of the president, he cannot be in charge of a fresh appointment.

Mlambo ruled that a new NDPP be appointed within 60 days.
