According to the court, Shoba placed nothing compelling before it when submitting his second bail application.

Shoba has been accused of the brutal murder of 28-year-old Tshegofatso Pule, who was 8-months pregnant at the time of her death.

Magistrate Delize Smith said Shoba brought no new evidence which would convince the court to grant him bail.

“These are not new facts as anticipated in the bringing of a new bail application. I will however refer to some of these. The applicant already at the first bail application indicated that he had cooperated with the police during the investigation. The mere fact that he now elaborates how he assisted with the CCTV at the complex is not a new fact as it was known at the day of the first application.”

Smith also slammed Shoba for failing to disclose certain aspects of his life during his bail application.

This includes facts that his grandmother would still be taken care of when he was not there.

He also did not disclose to the court that he and the woman he has paid lobola for, co-own their home.

“However, he does not disclose that his father and mother both receive pensions and that the brother is available to assist as they stay in the area. So the grandmother is not destitute without the assistance of the applicant.

“The applicant wants to have his house and his pension to be taken as surety for the amount of bail that must be paid. However he does not disclose that the house is on his and his lobola partner’s name. He however submits a statement to prove that the lady is not his house, but does not disclose that the bonded house is in both their names.”

The matter will be back in the court on 17 May for a formal indictment.
