Parliament to start discussing impeachment rules

The National Assembly will start discussing rules for the removal of a sitting president this week.

The Subcommittee on Review of Rules will sit for the first time this week, following a Constitutional Court ruling in December. 


The court ruled that Parliament had failed to put in place proper rules regulating the impeachment process.

 

Parliament spokesperson, Moloto Mothapo, says a draft procedure has been drawn up and will now be deliberated by the committee.

"In keeping with the Assembly's commitment to comply fully with the Constitutional Court's majority judgment, Members of Parliament serving on the National Assembly Rules Subcommittee have been notified of the forthcoming meetings and supplied with documents to be considered there."



The court ruled that the National Assembly failed to hold President Jacob Zuma accountable after the Nkandla judgement which found that Zuma failed to uphold and respect the Constitution.

 

Section 89 deals will the impeachment of a president if a two third majority vote is passed by members of the National Assembly. 

 

Once the draft procedure is finalised by the subcommittee, it would then need to be adopted by the National Assembly.
