Personal cost orders sets 'dangerous precedent', says Mkhwebane
Updated | By Lindiwe Mpanza
Public Protector Busisiwe Mkhwebane says making her pay her own legal bills is setting a dangerous precedent.
Mkhwebane made the remarks while delivering her annual report to the portfolio committee on justice on Friday.
In August the high court in Pretoria ruled that Mkhwebane is liable to pay a portion of the legal costs in the Vrede dairy farm matter.
The Constitutional Court also ruled that she pays 15 percent of legal costs in the Absa/Bankorp matter, a personal cost order which could see her paying some R900 000.
"I am still of the opinion that this is creating a lot of precedents because of a lot of people who are lodging those reviews, they are using that route now to say there must be a personal cost over public protection," Mkhwebane told MPs.
Mkhwebane added that she believes this poses a danger to the country's democracy.
