Robert McBride to hear his fate

The Constitutional Court is set to deliver a judgment today on whether or not the suspension of Ipid boss Robert McBride by Police Minister Nathi Nhleko last year, was unlawful.

McBride turned to the ConCourt in May this year, asking for it to have the North Gauteng High Court order - which found his suspension was unlawful - confirmed.
McBride has challenged the police minister's power to suspend him, arguing that IPID's independence was paramount.
He maintained the IPID Act was unconstitutional in giving the police minister such power over it - something the High Court agreed with - and making a suspended ordered that disciplinary proceedings be set aside pending parliamentary intervention.
McBride's suspension in March last year came in light of the so-called Zimbabwean rendition case dating back to 2010/2011.

He allegedly covered up the involvement of then Hawks boss Anwa Dramat and Gauteng Hawks head Shadrack Sibiya, in the unlawful rendition of four Zimbabweans.
Judgement in this crucial case is set to start at 10.
