The South Africa Social Security Agency (Sassa) has filed papers at the Constitutional Court, the Office of the Chief Justice confirmed.
Social Development Minister Bathabile Dlamini and Sassa had until 16:00 on Monday to provide answers over the social grants crisis.
There remains uncertainty over whether grants will be paid on 1 April when Sassa's contract with Cash Paymaster Services (CPS) expires.

"There were documents that Sassa filed electronically," Chief Justice Mogoeng Mogoeng's spokesperson Nathi Mncube said.
He refused to provide any further details as to the contents of the papers.
The questions include when Dlamini had known that Sassa would not meet the 1 April deadline to take over the payments of grants to 17 million grant recipients.
Sassa's contract with CPS had been declared unlawful by the Constitutional Court in 2014.
