A charge was laid against the ANC Western Cape leader in January during the ANC's 104th birthday celebration in Rustenburg earlier in 2016.

A woman accused Fransman of sexually harassing her while they travelled to the North West for the birthday rally.

He was placed on precautionary suspension, while police investigated the claims.

NPA regional spokesperson Frank Lesenyego confirmed that they would not be prosecuting Fransman.

"The Director of Public Prosecution in the North West province declined to prosecute the case due to insufficient evidence," Lesenyego said.

Lesenyego added that all parties have been informed.

Meanwhile, Fransman said he felt vindicated following the news.

"I said, upfront to the public, that I always knew there was no case. Secondly, I also knew there were people sending me messages before January and after January saying that they will take me down...in particular Mr [Jonton] Snyman, the regional secretary of the ANC in the Boland. Those are issues that are of a criminal nature, what he did to me, and I will definitely take this matter up," Fransman said.

The ANC has declined to comment until the NPA formally drops the charges.

"If indeed these charges were dropped for political expedience, we are going to take this matter further. We will be communicating in due course as the party once we get all the facts together," an ANC official said.
