Spy Tapes battle to continue

The high profile 'Spy Tapes' saga will return to court on 10 June when the North Gauteng High Court in Pretoria will hear the appeal by President Jacob Zuma and the National Prosecuting Authority (NPA).

The two parties want to take the case to the Supreme Court of Appeal in Bloemfontein, following the High Court ruling that an irrational decision was taken in 2009, when the NPA dropped more than 780 charges against the president.


The DA brought the case and Mabine Seabe confirmed they received notice.


"We will contest this application, because we strongly believe it is a case for President Zuma to answer for and we are willing to fight this until the very end," Seabe said.


The NPA on Monday said it has applied for leave to appeal.


The National Director of Public Prosecutions, Shaun Abrahams, said the judgement by the full bench of the High Court was a matter that seriously affected the separation of powers and was so important that it needed the decision of an appeal court.


"It has far reaching ramifications for the powers of the institution and for the very citizenry of our republic and our young democracy. Whilst the issue arises in a high profile case, it is the only decision on this point and I believe with respect to the High Court judgement, that it should be considered by an appeal court," Abrahams said.
