State accused of ‘delay tactics’ in AKA, Tibz murder case

Lawyers representing five of the seven men accused of the murders of rapper Kiernan 'AKA 'Forbes and his friend Tebello ‘Tibz’ Motsoane have accused the State of delaying the case.

The defence presented arguments for their clients’ bail applications in the Durban Magistrate’s Court on Thursday.
Advocate Simphiwe Mlotshwa, representing two of the five men, told the court there is a lack of clarity from the State.
“The presumption is everybody is able to articulate themselves. If that were the position, Mr Pillay, the investigating officer, would have stated exactly in those clear terms. This goes back to the concern that I’ve raised, the generic allegations.
“It would have helped all of us if the State was able to take everybody into full confidence and tabulate that this is X, Y, Z that is outstanding. It doesn’t help to just generically refer to the investigations as just being at an advanced stage.”
The other two accused are set to appear at the Eswatini Magistrate court later this month as they await extradition.
Forbes and Motsoane were gunned down outside a restaurant on Florida Road in February last year.
The case has been postponed to Friday.
