Student activist Bonginkosi Khanyile takes his fight to be released to the ConCourt

Fees Must Fall activist Bonginkosi Khanyile is heading to the highest court in the land to challenge the refusal to grant him bail.

Khanyile was arrested in February 2016  on charges relating to the countrywide fees protests at tertiary institutions. He was initially granted bail, but was re-arrested in September 2016 and hasn't been released since.


Despite calls by student leaders and politicians, Khanyile remained behind bars for the five months. He has now decided to approach the Constitutional Court, arguing that his right to a fair trial has been infringed upon.

Khanyile believes the magistrate failed to conduct an inquiry into the alleged breaches of his bail conditions which resulted in his incarceration.


Students have gathered at the Constitutional Court in Braamfontein in solidarity with Khanyile, amid the ongoing bid for free, quality, higher education.
