Taking Mkhwebane report on judicial review ‘futile’

A civil society organisation believes the EFF would be barking up the wrong tree should it make good on its threat to take Parliament's Section 194 report on Busisiwe Mkhwebane on judicial review.

The remarks by Accountability Now’s Advocate Paul Hoffman Hoffman, come after the National Assembly on Monday overwhelming voted to remove the suspended Mkhwebane from office.


The EFF, which voted against the adoption of the report by the committee tasked to determine her fitness to hold office, vowed to take the report on review.


The committee found Mkhwebane guilty of misconduct and incompetence.


Hoffman said he believed Mkhwebane's impeachment was long overdue.


"The decision by Parliament is the right decision. It will withstand any challenge on the part of either Mkhwebane or any of her supporters. There is no way that the court will agree with any argument that suggests that she did not get fairness when she was impeached as a result of the report of the committee that looked into her incompetence and misconduct."


Mkhwebane has slammed the DA and ANC, accusing them of working together to ensure she doesn't receive her R10 million gratuity at the end of her term in October.
