Trio set to return to court in July for Nathaniel Julies pre-trial hearing

Judgment in the bail application of murder accused cop Simon Scorpion Ndyalvane has been postponed.

Ndyalvane is one of three officers charged with murder, possession of illegal ammunition and defeating the ends of justice in the death of Eldorado Park teen Nathaniel Julies.

 

Julies, who lived with downs syndrome, was shot dead last August just meters away from his home - sparked outrage in the community.

 

Ndyalvane appeared in the High Court in Johannesburg on Thursday where he re-applied for bail based on new evidence.

 

"In the meantime, the state will try to assist Mr Ndyalvane in terms of expediting his application to be released on bail on new facts to be heard should there be an available judge since the High Court is going on recess," said Phindi Mjondondwane, spokesperson for the National Prosecuting Authority (NPA) in Gauteng.

 

"Should there be a judge available to hear his bail application on new facts before the 23rd of July 2021, he will then be requisitioned to come to the High Court for his bail application."

 

Ndyalvane, alongside co-accused Cayleen Whiteboy and Voster Netshiongolo will return to the Johannesburg High Court on July 23 for a pre-trial hearing.

 

Netshiongolo is accused of planting bullets at the scene of Nathaniel’s murder to make it look as if there had been an earlier confrontation between police and local gang members.

 

The state also believes Netshiongolo covered the teenager’s blood at the scene.
