Tshwane battle heading to Constitutional Court in September

The ongoing legal battle between the Gauteng government and the Democratic Alliance (DA) over control of Tshwane will be heard in the Constitutional Court in September.

All arguments will be presented to the apex court in written format on September 10.
Last month, the Gauteng provincial government approached the Constitutional Court on an urgent basis over a damning judgment by the High Court in Pretoria, which found the decision to dissolve the Tshwane council unlawful.
The DA mayoral candidate Randall Williams says the provincial government has doubled-up in its efforts to keep Tshwane under administration.
“They used a double-barrel approach. They applied for direct access to the Constitutional Court to hear the appeal, but at the same time they also applied to the North Gauteng High Court for leave to appeal to the Supreme Court of Appeal, in case the Constitutional Court did not grant them direct access.
“In that notice that we’ve received from the Constitutional Court they set out the dates by which the parties must file their arguments.”

In his weekly letter, the president said the total number of confirmed cases are expected to pass the 50 000 mark this week. ALSO READ: 998 people have lost their lives to Covid-19 in SA Ramaphosa said government is also expecting the death toll to pass 1 000.
Williams adds the delay in a final decision will have an impact on service delivery in the city.
“You get a type of service that’s not being delivered by the administrators, the required level of services are not being delivered by the administrators.
“The residents will obviously be badly affected and we’re hoping that this situation can be resolved soon.”
The municipality was placed under administration in March and administrators appointed in subsequent weeks.
