Vodacom turns to ConCourt in 'Please Call Me' saga
Updated | By Jacaranda FM News
Vodacom has approached the Constitutional Court in the ongoing “Please Call Me’ saga.
The company has turned to the apex court after the Supreme Court of Appeal ordered the cellphone giant to make a fresh determination of the compensation owed to the inventor of “Please Call Me”, Nkosana Makate.
The former employee rejected the previous offer of R47 million, and the appeal court found he was due between five- and 7.5 per cent of the total revenue of the product over a period of 18 years – estimated at R70 billion.
Vodacom was ordered to finalise the new offer by next week.
“The impact of the SCA Judgment, should it be upheld, would be vast and wide-ranging on both Vodacom South Africa and Vodacom Group, as well as the attractiveness of South Africa as an investment destination,” Vodacom said in a statement.
“It would negatively impact our employees, shareholders and Vodacom's contribution to public finances. It would also have an impact on our network investment, coverage, and social programmes.
Vodacom said that while previous negotiations with Makate failed to yield any results, the company remains open to “constructive dialogue and good faith negotiations”.
