His lawyers have made a formal submission to appeal an earlier South Gauteng high court ruling after Mvoko was not scheduled for work due to a front page article that he penned on his experience at the SABC.

In dismissing Mvoko’s case, The South Gauteng high court ruled its too early to pronounce on the constitutionality of issues raised as the SABC still has its own investigations to conclude before deciding on whether to terminate Mvoko’s contract.

Mvoko’s lawyers argued the mere fact that he was not given work, for any amount of time, is a violation of his rights.

Mvoko’s lawyers believe the court erred in ruling that him not being scheduled for work, was a temporary matter.

Earlier this month he took the public broadcaster to court after he was removed from the line-up but the South Gauteng High Court dismissed his application.

Although Mvoko has a contract with the SABC, he only gets paid if his programmes are aired.

The public broadcaster stopped using Mvoko's material after he wrote an article criticising the SABC's stance banning the broadcast of violent images during protests in which state property was being destroyed.
