Zondo commission postpones Mti, Nair’s Bosasa testimony

The commission of inquiry into state capture has postponed two key testimonies related to alleged corruption at controversial facilities management company Bosasa.

Former correctional services commissioner Linda Mti and Pretoria Chief Magistrate Desmond Nair were expected to appear before the commission on Tuesday.


They were both implicated by former Bosasa COO Angelo Agrizzi and others.

 

Agrizzi told the commission that Bosasa received illegal tenders from the Department of Correctional Services during Mti’s time at the helm.

 

He claimed the company paid Mti R65 000 a month.

 

He also fingered Nair as one of several high-profile people who benefitted from Bosasa's coffers.

 

This while Agrizzi’s former colleague Richard le Roux also confirmed to the commission that he installed security upgrades at Nair’s Pretoria home.

 

The two men’s legal representatives told the commissions chairperson, Deputy Chief Justice Raymond Zondo, that they only received notices to appear before the commission on July 10.

"We did receive the notice of today's hearing on the 10th of July. Just as Mr. Mti, Mr. Nair is here, we are ready, we are prepared and he was ready to give his evidence. However, we were this morning informed that two further statements might be forthcoming,” said Nair’s legal representative Advocate Danie Dorfling.

 

"We were further informed there is another statement that is forthcoming from Mr. Le Roux. Mr. Le Roux deposed his first statement on the 28th of January 2019 and gave evidence on the 31st of January 2019 and we did not receive a Rule 33 notice forewarning Mr Nair of that and alerting him to the rights he has in terms of Rule 3, which has caused some prejudice.”

 

Zondo subsequently postponed both men’s testimonies.

 

A new date would be set down for testimony once the lawyers have come to an agreement with the commission.
