Zuma empowered to appoint state capture commission judge: ANC

ANC Secretary General Gwede Mantashe says the ruling party supports an inquiry into state capture, but believes it should be set up like any other commission of inquiry.

Mantashe briefed the media at the party's headquarters in Johannesburg after yesterday's National Working Committee meeting.
Mantashe says President Zuma is constitutionally empowered to appoint a judge to head up a commission of inquiry.
He also believes former Public Protector Thuli Madonsela's remedial actions in the State of Capture report are open to interpretation, which is problematic.
"The Chief Justice should appoint the judge. It goes further to say that judge must appoint the team he will work with. The problem with that is the remedial action constitutes a commission which is prescribed by the constitution on how it is appointed. That is our question and we are hoping that people will take that report on review. We will have to clarify that point. That goes to the appointment of Justice Moseneke. I don't know if we have appointed retired Judge Dikgang Moseneke to chair that commission. That talks to our point that once you make give remedial action that is open for all interpretation anyone will pronounce on who should be the judge," says Mantashe.
Mantashe also dealt with the letter written by former President Thabo Mbeki to President Zuma, saying if Mbeki wished to advise the president he should do so quietly.
