Lawyer cautions public on High Court judgement

The High Court in Pretoria has declared levels 4 and 3 of the lockdown regulations unconstitutional and invalid.

Hammer Breakfast

Megan Harrington Johnson, an attorney from HJW in Johannesburg, joined Breakfast with Martin Bester on 3 June.

HJW Attorneys was recognised as one of Africa’s Leading Boutique Law Firms in 2019.

Harrington Johnson wants to caution the public. The lawyer says this order does not have immediate effect. The lockdown regulations are still in place and should be applied by every citizen of South Africa.

The current regulations will remain in place for the next 14 days while the government remedies the situation.

The court directed Minister of Cooperative Governance and Traditional Affairs Nkosazana Dlamini-Zuma on Tuesday, 2 June, in consultation with the relevant ministers, to review, amend, and republish the regulations.

Regulations around the ban on the sale of tobacco products have not been affected by the order since the ban is the subject of a separate legal challenge.
