Corruption Watch to lay charges against SARS commissioner

Corruption Watch says it will be laying criminal charges against SARS Commissioner Tom Moyane after he failed to act on the findings of a report from the Financial Intelligence Centre (FIC).

The findings detailed fraud and corruption by senior SARS employees, Jonas Makwakwa and Kelly-Ann Elskie.


In the letter written to Moyane, Corruption Watch says "We understand that there were a total of 75 suspicious transactions done between 1 March 2010 and the 31 January 2016 by Mr Makwakwa and Ms Elskie, R785 130.00 linked to Mr Makwakwa and R450 200.00 linked to Ms Elskie."


Corruption Watch says the matter should have been reported to the Directorate of Priority Crime Investigation (DPCI) and his failure to act is unlawful.


The anti-corruption organisation says Moyane is obliged to report knowledge or even mere suspicion of corrupt transactions over R100 000 to the DPCI.


"We treat this in the most serious light. If the commissioner of our revenue collecting agency cannot be entrusted to act against corruption, then who can? We are determined that the Hawks should act against him. Should they fail to do so we will examine our legal options in relation to the responsible law enforcement agencies," says executive director of Corruption Watch David Lewis.


Lewis says Moyane also contravened the Financial Intelligence Centre Act when he notified Makwakwa and Elskie of the FIC report.


Corruption Watch has given Moyane the opportunity to respond to these issues by no later than 1 November 2016.
