Johannesburg businessman Adam Catzavelos has lost his bid to have criminal charges against struck off the roll.
Catzavelos is attempting to avoid prosecution on crimen injuria charges, laid by the Economic Freedom Fighters (EFF) in Gauteng, after an explosive video in which he used the k-word to express joy at not seeing a single black person while on a beach in Greece.
The National Director of Public Prosecutions has decided that he must stand trial.
Spokesperson for the National Prosecuting Authority (NPA) in Gauteng Phindi Mjondondwane says Catzavelos made a brief appearance at the Randburg Magistrate's Court on Tuesday.
"On a previous occasion the matter was postponed for the outcome of the representations that Catzavelos did to the office the National Director of Public Prosecutions and the outcome was that prosecution must proceed."
Mjondondwane confirmed that Catzavelos will be entering into a plea bargain with the state, pending an agreement.
"The matter has been postponed to the 5th of December as the defense team indicated that they want to enter into a plea bargain with the state."
