ANC vows to appeal ‘vindicated’ MK in trademark spat
The founder of uMkhonto weSizwe Party Jabulani Khumalo believes it's been vindicated by the courts.
On Monday, the Durban High Court dismissed the ANC’s trademark case against the MK party with costs.
The governing party had accused the MK party of violating the Trademarks Act by using a name and logo similar to that of the ANC’s disbanded military wing.
Khumalo, who addressed the media outside court, said they were delighted with the court ruling.
“I’m over the moon. I’m happy that the ANC has been shown that they can’t fight the MK. We are unstoppable. Whether they like it or not, they must just forget it. We have won with costs, and they must pay.”
At the same time, the ANC’s KwaZulu-Natal spokesperson, Mafika Mndebele, said the governing party would appeal the ruling.
“We are going to challenge this all the way to Constitutional Court. It’s not about winning or losing. It’s a matter of principle. Our historical demand and mandate is to do everything in our power to defend the ANC brand, its legacy, and all institutions associated with the brand.”
But Khumalo urged the ANC to accept defeat and move on.
“They can appeal as many times as they want but we will still win it because they have no facts. They were just trying to disturb us from winning the elections.”
